PRIVACY AND PERSONAL DATA PROTECTION NOTICE

This Privacy & Personal Data Notice (Notice) describes how Hafidz Hud & Partners (HHP) collects, uses, and discloses certain personal data & information obtained through your engagement of our services, through your email communication with us, through  our general business contact with you, and through our public website at www.hafidzhud.com (Website). 

1. INTRODUCTION

The Personal Data Protection Act 2010 has come into force on 15 November 2013 to regulate the processing of personal data in commercial transactions. The Act, which applies to all companies and firms that are established in Malaysia, requires us to inform you of your rights in respect of your personal data that is being processed or that is to be collected and further processed by us and the purposes for the data processing. The Act also requires us to obtain your consent to the processing of your personal data.

By your engagement of our services, through your email communication with us, through  our general business contact with you, and through our Website (collectively and/or separately referred to as "engagement" or "dealing" or "services"), you consent to the processing of your Personal Data by HHP and all persons involved in the provision of services by HHP.

In the event of any conflict between the English and other language versions, the English version shall prevail. HHP shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the Website. Continuing to communicate, deal or engage with us or using this Website following the modifications, updates or amendments to this Notice, shall indicate your acceptance of such modifications, updates or amendments.

2. COLLECTION OF PERSONAL DATA
In the course of your dealings with us, we will request that you provide data and information about yourself, your organisation, your employees and/or your customers (“Personal Data”) to enable us to enter into transaction with you or to deliver the necessary services and/or deliverables in connection with our business.

Such Personal Data may include information concerning name as per identity card, preferred name, identity card number, age, contact number, residential address, e-mail address, birth date, gender, occupation, designation, bank account details, information of spouse/ children such as name and birth date, information as to physical or mental health, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of an offence and other such data necessary for the performance of our services to you.

 

Processing Personal Data means collecting, recording, holding or storing the Personal Data or carrying out any operation or set of operations on the Personal Data such as the following:

  • Organization, adaptation or alteration of Personal Data;

  • Retrieval, consultation or use of Personal Data;

  • Disclosure or make available Personal Data by transmission, transfer or dissemination; and/or

  • Alignment, combination, correction, erasure or destruction of Personal Data.

3. PURPOSE OF PERSONAL DATA PROCESSING

The collection of Personal Data is essential for our business operations, encompassing processes, execution, including the delivery of services and/or deliverables, as well as client relationship management. The Personal Data you provide will be collected, utilized, and otherwise processed by us for various purposes, including but not limited to:

  • Communication with you (including to respond to questions and comments from you);

  • Internal administrative purposes;

  • Compliance with legal and regulatory requirements concerning our provision of services and deliverables, including disclosures mandated by applicable laws, regulations, court orders, guidelines, circulars, or codes;

  • Delivery of services or deliverables and marketing thereof, both present and future, to you;

  • Facilitating payment for our services;

  • Managing user or client relationships; 

  • Fulfilling specific purposes outlined in any service; 

  • Conducting training, awareness programs, client promotional activities, marketing, and client profiling associated with our services and related deliverables; and/or

  • Other legitimate activities in connection of your engagement or dealing with us.

You agree and consent to the processing and using of your Personal Data as specified in this Notice. The failure to supply such Personal Data may result in our inability to provide clients with the services requested and to to update you on legal developments.

 

4. DISCLOSURE & TRANSFER

Please be informed that if required for any of the foregoing Purposes, your Personal Data may be disclosed to the following:

  • any person to whom we are compelled or required to do so under law or in response to a competent regulatory or government agency;

  • our auditors, consultants, accountants, insurers, lawyers, or other financial or professional advisers and the Bar Council; and

  • our sub-contractors or third party service or product providers as may determine to be necessary or appropriate

HHP shall endeavour to keep all personal data confidential and endeavours to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of personal data and accidental loss or destruction of, or damage to, Personal Data.

 

Where we consider it necessary or appropriate for the purposes of data storage or processing or providing any service or deliverable on our behalf to you, we may transfer Personal Data to a third party service or product providers within or outside the country in which we are established, under conditions of confidentiality and similar levels of security safeguards.

5. RIGHTS TO ACCESS, CORRECTION REQUEST & INQUIRIES

You may at any time hereafter make inquiries, complaints and request for access to, or correction of, your Personal Data or limit the processing of your Personal Data by submitting such request to the Personal Data Protection Officer of the Firm via email to the following:
